Welcome to a new year (almost)! Artemiste has compiled our annual round up of new regulations to help you start the New Year right!

UPDATE - Employee Handbook – a handbook is a valuable resource for employers to communicate policies and company expectations but it’s crucial to keep up to date. We’ve identified a few areas to pay particular attention to that are new for 2021 including:


· Family and Medical Leave Expanded (CFRA) [SB1383]

o Now covers employers with 5 or more employees, expands the definition of family members and eliminates the New Parent Leave Act.


ABC Test for Independent Contractors [AB2257]

o Clarifies provisions to determine if a worker should be classified as an employee or independent contractor and creates additional exceptions.

· Leave for Victims of Crime and Abuse [AB2992] – Updated provisions

· Paid Family Leave (PFL) [AB2399] – Updated time off provisions

· Paid Sick Leave Designation [AB2017] – Employee discretion added

· California Consumer Privacy Act (CCPA) – Notices required

· Harassment Prevention Training Requirements - Expanded

o CA has expanded the requirement to provide harassment prevention training to all employers with 5 or more employees within six months of hire or promotion.

New - Minimum Wage and Minimum Salary Levels


Effective January 1, 2021, the new CA minimum wage for small employers (25 employees or less) is $13 per hour and for large employers (26 employees or more) the new wage is $14 per hour.

Many cities including Los Angeles, San Diego and San Francisco and others have enacted higher minimum wages and employers must pay their employees the highest applicable wage rate.

The minimum salary level for exempt employees is also increasing. In CA exempt employees must be paid the equivalent of two times the state minimum wage. Small employers (25 or fewer employees) must pay a salary of at least $54,080 annually while large employers (26 or more employees) must pay a salary of $58,240 annually.


In addition, CA has a separate minimum salary for certain computer professionals. The new annual salary is $98, 907.70. Employees designated as computer professionals must also still satisfy the CA duties test, which is different from federal FLSA standards.


Next Steps:


· Order new labor posters for 2021 and post in a conspicuous area where all employees can see – if you have multiple locations you are required to post in all locations.

· Update your Employee Handbook.

· Ensure your minimum wage and salary levels are in compliance with state and local ordinances.

· Review the new exceptions to the AB5 regulations and determine if any reclassifications are needed.

· Update your leave and absence policies for victims of crime or abuse, the new PFL regulation and new Paid Sick Leave regulations.

· Ensure your employees receive harassment prevention training and that you retain a record of such training.

· Update your data collection polices and procedures to comply with CCPA.
